1.5. Die Mitgliedschaft kommt erst durch Annahme des Mitgliedsantrags durch Carlo Colucci zustande.

1.6. Carlo Colucci ist nicht dazu verpflichtet, neue Mitglieder aufzunehmen.

1.7. Jedes Mitglied erhält ein Carlo Colucci-Konto („Konto“).

1.8. Jede natürliche Person darf nur ein Konto haben.

1.9. Die Mitgliedschaft ist nicht übertragbar.

1.10. Die Mitgliedschaft ist kostenlos.

1.11. Wesentlicher Bestandteil der Mitgliedschaft und der Carlo Colucci-Leistungen ist der regelmäßige Empfang von E-Mails mit Informationen über aktuelle Verkaufsaktionen, Produktempfehlungen, Gutscheinen und den VIP-Status („Newsletter“). Mitglieder haben jederzeit die Möglichkeit, den Newsletter in den Einstellungen in ihrem Konto oder über den vorgesehenen Abmelde-Link in jedem Newsletter wieder abzubestellen.

1.12. Das Mitglied verpflichtet sich, die AGB einzuhalten. Die Zugangsdaten sind geheim zu halten. Besteht der Verdacht, dass Zugangsdaten durch Dritte genutzt werden, ist das Mitglied verpflichtet, Carlo Colucci unverzüglich zu informieren und das Kennwort zu ändern.

2. Laufzeit und Kündigung der Mitgliedschaft

2.1. Die Mitgliedschaft besteht auf unbestimmte Zeit.

2.2. Das Mitglied und Carlo Colucci sind jederzeit berechtigt, die Mitgliedschaft ohne Angabe von Gründen mit sofortiger Wirkung zu kündigen.

2.3. Bestellt ein Mitglied über einen Zeitraum von über einem Jahr oder mehr keine Waren über das Konto, steht es im Ermessen von Carlo Colucci, das Konto zu deaktivieren. Carlo Colucci wird das Mitglied einen angemessenen Zeitraum vor einer Deaktivierung per E-Mail darauf hinweisen und dem Mitglied die Möglichkeit geben, eine Deaktivierung zu verhindern. Insbesondere wenn das Mitglied über das Konto bis zur Deaktivierung Ware bestellt, kann Carlo Colucci von der Deaktivierung absehen. Auch nach Deaktivierung eines Kontos kann erneut eine Mitgliedschaft erworben werden.

2.4. Die Kündigung hat keine Auswirkungen auf bereits getätigte Bestellungen über den Onlineshop. Etwaige Rücktritts- und Widerrufsrechte des Mitglieds bleiben von der Kündigung unberührt. Rechnungen und Vertragsdokumente können nach Wirksamwerden der Kündigung nur auf Einzelfallbasis und bei eindeutiger Identifikation des Kontos bzw. des Mitglieds über den Kundenservice herausgegeben werden.

2.5. Sollte ein Mitglied den AGB oder Teilen davon widersprechen, endet seine Mitgliedschaft automatisch mit dem Zugang des Widerspruchs bei Carlo Colucci, nachdem es auf die drohende Beendigung hingewiesen wurde und zwischen Widerspruch und Beendigung ein angemessener Zeitraum lag.

3. Cashback Club

3.1. Allgemeines

3.2. Carlo Colucci belohnt besonders treue Mitglieder im Cashback Club. Die Mitglieder können durch bestimmte Aktivitäten Punkte sammeln. Je nach Punktestand kann das Mitglied den Silver-, Gold- oder Diamond-Status erreichen. Diese Angebote können zeitlich begrenzt sein, nur in ausgewählten Ländern und Rechtsordnungen gelten und für die Zukunft ohne Angaben von Gründen jederzeit beendet werden.

3.3. Die Gutschrift der Punkte kann bis zu sechs Wochen dauern.

3.4. Der jeweilige Status ist für 24 Monate gültig. Sollte ein Mitglied während dieses Zeitraumes ein höheres Level erreichen, wechselt es automatisch in den nächsthöheren Status. Der neue Status bleibt dem Mitglied ebenfalls für einen Zeitraum von 24 Monaten.

4. Rabatt-System

4.1. Der Rabatt beträgt für Silver-Kunden, die einen Umsatz von mindestens 2.000 € erreicht haben, 10 % des Umsatzes.

Für Gold-Kunden, die einen Umsatz von mindestens 10.000 € erreicht haben, beträgt der Rabatt 20 % des Umsatzes.

Diamond-Kunden, die einen Umsatz von mindestens 20.000 € erreicht haben, erhalten 30 % des Umsatzes. Die Höhe des Rabatts hängt vom Statuslevel des Mitglieds ab.

4.2. Der Rabatt wird bei der Bestellung direkt vom Kaufpreis abgezogen und ist sofort gültig. Es erfolgt keine zusätzliche Gutschrift auf einem Rabattkonto.

5. Nutzung als Geschäftsmodell

5.1. Jedes Mitglied hat die Möglichkeit, auch für Freunde und Bekannte einzukaufen. Durch den Einkauf für andere können Mitglieder von den Rabattvorteilen profitieren.
